Terms of Service

These Terms of Service ("Agreement") are entered into between ContAdGO OÜ ("Company", "we", "us") and any individual or legal entity ("User", "you") who accesses or uses the DmAgent services ("Service"). By using our Service, you agree to be bound by all terms and conditions of this Agreement.

DmAgent is a SaaS platform that provides AI-powered automated response, appointment management, reminders, and CRM services for businesses via Instagram DM, WhatsApp Business, and website integration. The Company reserves the right to change the scope, features, and pricing without prior notice.

You must create an account to access the Service. You are required to provide accurate, current, and complete information. You are responsible for maintaining your account password's confidentiality and for all activities under your account. Notify us immediately upon discovering any unauthorized use or security breach.

You may use our Service only for lawful purposes and in accordance with this Agreement. The following are strictly prohibited: • Using the Service for misleading, fraudulent, or illegal purposes • Attempting unauthorized access through automated tools • Violating the rights of other users or third parties • Sending spam, unsolicited communications, or malicious content • Taking actions that compromise the security, integrity, or performance of the Service

Our Service is billed on a subscription basis. Subscription fees are collected in advance for the selected billing period (monthly or annual). If you cancel before the end of the current billing period, you will not be charged for the next period. Partial period refunds are not provided.

The processing of your personal data is governed by our separate Privacy Policy. Our Company complies with its obligations under the EU GDPR. By using the Service, you consent to data processing as described in our Privacy Policy.

All intellectual property rights in the Service, including the DmAgent platform, logo, design, software, and content, belong to ContAdGO OÜ and are protected by copyright, trademark, and other applicable laws.

The Service is provided "as is." To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages. The Company's liability for direct damages is limited to the last 3 months of subscription fees.

The Company may suspend or terminate your account if you violate this Agreement. You may also discontinue use of the Service at any time by closing your account.

This Agreement shall be governed by the laws of Estonia. Disputes shall first be resolved through negotiation; if unresolved, the competent courts in Tallinn shall have exclusive jurisdiction.

The Company reserves the right to update this Agreement at any time. Material changes will be communicated via email or platform announcement. Continued use of the Service after a change takes effect constitutes acceptance.
